Gov Proposes Immediate Licence Suspension for Substandard Drugs

The Union Health Ministry has proposed changes to the 1945 Drugs Rules to quickly suspend manufacturing licences of drugs found to be substandard based on key quality tests. The government announced this plan on November 4, 2026, aiming to stop the production and sale of faulty medicines faster and improve public health safety.

Currently, before suspending a licence, authorities must follow a lengthy process that includes issuing warnings. This delay allows substandard drugs to stay in circulation, posing risks to patients and making recalls harder. To fix this, the new rules would let licensing bodies suspend a manufacturer’s licence immediately after receiving a government analyst’s report showing poor quality in critical areas like purity or strength.

Under the proposed changes, manufacturers must take corrective actions before their licences can be reinstated. This includes fixing the issues causing the quality problems and proving they won’t happen again. The new rules also aim to improve coordination among regulators by sharing reports with more authorities, including state licensing bodies and drug makers.

These amendments were suggested after discussions at two important meetings in 2024 and 2025. They are now open for public feedback for 30 days. The goal is to make sure bad-quality drugs are removed from the market faster, hold manufacturers accountable, and boost trust in India’s drug quality standards.
