New Delhi Rejects Court of Arbitration Ruling on Indus Water Treaty

India has strongly rejected a recent decision by the Court of Arbitration in The Hague over the Indus Waters Treaty with Pakistan. The Indian government said the tribunal has no authority over India and that its decisions are not valid for New Delhi.

The Ministry of External Affairs (MEA) said India never accepted the arbitration process and did not take part in the proceedings. Because of this, India said it does not consider the tribunal’s ruling binding and will not follow its directions.

What Did the Court Say?

The Court of Arbitration ruled that India’s reasons for suspending the Indus Waters Treaty were not valid. The court also called on India to continue following the 1960 treaty.

The treaty was signed between India and Pakistan to manage the use of water from the Indus River system. It divides the use of several rivers between the two countries and has remained an important agreement in India-Pakistan relations for decades.

However, India has rejected the latest ruling. New Delhi argues that the arbitration panel itself was created in a way that does not follow the terms of the treaty.

Why Did India Suspend the Treaty?

India suspended the Indus Waters Treaty after a terrorist attack in April last year. The government linked the decision to national security concerns and said relations with Pakistan had changed significantly.

India has maintained that the treaty cannot be treated separately from the broader security situation between the two countries.

Following the suspension, India has taken steps related to water management and infrastructure projects on rivers covered by the treaty. Pakistan has opposed these moves and has sought international intervention.

India’s Position

The MEA has made it clear that India does not accept the authority of the Court of Arbitration in this matter.

According to the government, India did not recognise the tribunal, did not participate in its proceedings, and therefore does not accept its conclusions.

India also said that decisions about its sovereign territory, national security and water infrastructure cannot be controlled by an outside body.

New Delhi’s position is that the country’s water projects and related decisions are matters for India to decide on its own.

Why Is the Issue Important?

The dispute is important because the Indus Waters Treaty has been one of the few agreements that continued to operate even during periods of serious tension between India and Pakistan.

Any major change in the way the treaty is followed could have wider consequences for relations between the two countries.

Pakistan depends heavily on the Indus river system for agriculture, drinking water and other economic activities. India, meanwhile, has long argued that it should have greater flexibility to use the water resources available to it under the treaty.

A Larger India-Pakistan Dispute

The latest disagreement is part of the larger and continuing tension between India and Pakistan.

India has repeatedly raised concerns about terrorism and security, while Pakistan has challenged India’s actions on several international platforms.

The dispute over the Indus Waters Treaty adds another difficult issue to an already complicated relationship.

For now, India has made its position clear: it does not accept the authority of the Court of Arbitration in this case and does not intend to follow its ruling.
