“The Congress President has manufactured a statistic, Rs 500 crore versus Rs 1,600 crore, a data which does not exist anywhere on any record,” Jaitley told reporters.

“And on that manufactured data he (Rahul Gandhi) repeatedly lied before the country on various occasions.

“Ordinarily when the Supreme Court saw the pricing, examined the procedures and offset provisions and found no substance, the controversy should have come to an end,” he said.

Jaitley said now with the Comptroller and Auditor General (CAG) going “through the entire transaction” in a constitutional process “and after looking at it in the conserved manner… what did the CAG say?

“Our NDA’s deal is cheaper than the 2007 transaction. And keep in mind this is 2.86 per cent cheaper than that they have mentioned,” he said.

He said that the National Democratic Alliance (NDA) deal could actually be wider because of two reasons. “One because of the 2016 package of the weaponry, because of nine years of advancement and much more sophistication.

“Secondly, the escalation clause in 2007 was 3.7 per cent per year and in 2016 it is 1.2 per cent, which is European inflation rate. Now this in comparison as of 2016, and when the aircraft starts arriving from 2019 onwards and subsequent years, this 2.3 per cent gap in the escalation clause will be compounded every year to the advantage of far cheaper to be continued,” he said.

Jaitley also said that the maintenance provisions are better, the delivery schedule is tighter, the transaction has been negotiated at a much faster pace and they have not found anything fundamentally wrong with the transaction.

His remarks came after the CAG report was tabled in Rajya Sabha by the government. The audit report found that the Rafale deal signed by the NDA government was priced 2.86 per cent lower than what was negotiated by the United Progressive Alliance (UPA) government.

The report does not disclose the actual price of the 36 Rafale fighter jets contracted by the NDA government. However, it includes examination of the pricing.

The prices have been redacted in the report based on the insistence of the Defence Ministry citing the Indo-French agreement of 2008 and the provisions of inter-government agreement.

Attacking the Congress, the BJP leader said that there are some vested interests that may have either corporate rivals in mind or political opposition in mind or perhaps both.

“Who have been trying to make this deal controversial? Don’t forget what started in the year 2000 was stalled in the year 2012 by the UPA. National security was compromised and no valid reason has come till date that why this deal was put on the backburner in 2012 itself.

“This is a combat aircraft which the forces need desperately. And I am proud of the fact that our government has negotiated a cheaper and a much better deal and every term of the transaction is much better,” he said.

“The matter is yet not finished as the people need to punish those who misled the country. This is exactly the repetition of 1989. This is the legacy of Congress and this is Rahul Gandhi’s legacy,” he said.

Citing the example of the Bofors scandal that had hit the Congress government in 1989, Jaitley said, “In 1989, the Congress government led by late Rajiv Gandhi was mired in corruption and thus they manufactured a St Kitts against (former Prime Minister) late V.P. Singh who had a clean image.

“Exactly 30 years later, the Congress scandals are evident from the disclosures made in courts everyday. And because Prime Minister Narendra Modi has a clean image let us manufacture a crisis,” Jaitley added.

Earlier in the day, soon after the CAG report was tabled in Parliament, Jaitley took to Twitter and said that “truth shall prevail” and the CAG report reaffirms the dictum.

“How does democracy punish those who consistently lie to the nation? The lies of ‘Mahajhootbandhan’ stand exposed by the CAG report,” he tweeted.

According to sources, Justice Sikri was nominated by the Modi government to the prestigious post of President/ Member of the London-based Commonwealth Secretariat Arbitral Tribunal (CSAT).

CSAT is the final adjudicator of disputes arising out of contracts entered into by or on behalf of the Commonwealth Secretariat. After reports of his nomination emerged, Justice Sikri declined his “consent” for the post.

Reacting to the development, Gandhi tweeted: “When the scales of justice are tampered with, anarchy reigns.”

“This Prime Minister will stop at nothing, stoop to anything and destroy everything, to cover up the Rafale Scam. He’s driven by fear. It’s this fear that is making him corrupt and destroy key institutions,” said Gandhi tagging a media report about the post-retirement offer to the Supreme Court judge.

Sikri was part of the Selection Committee including Prime Minister Narendra Modi and Leader of Congress in Lok Sabha Mallikarjun Kharge that on Thursday decided 2:1 to remove CBI chief Verma from the post. Kharge gave a dissenting note and opposed Verma’s ouster.

“The Prime Minister is currently being held hostage by the Rafale scam. A person who has sacked the CBI Chief twice in a row and is terrified to let the CBI Chief sit there for fifteen minutes has no business talking about anything,” Gandhi said while addressing media here in Dubai.

A heated debate on the Rafale jet deal began in the Lok Sabha amid loud protests and sloganeering by AIADMK members over the Cauvery water dispute.

While attacking Modi over the Rafale deal, Gandhi referred to the agitating Tamil Nadu MPs and said: “It is a tragedy that our friends in AIADMK are trying to protect Prime Minister Modi”.

He also targeted Defence Minister Nirmala Sitharaman over her assertions that the pricing of the France-built jets was confidential.

“Defence Minister is hiding behind AIADMK. She publicly stated that price is a secret. But she has been contradicted by French President himself who said that price is not a secret,” said Gandhi.

AIADMK members disrupted the proceedings in both the Houses of Parliament on the day.

The review petition moved by former Finance Minister Yashwant Sinha, journalist-turned-politician Arun Shourie and activist lawyer Prashant Bhushan have sought an open court hearing on the plea seeking a recall of the December 14 judgment.

ரபேல் போர் விமான ஒப்பந்தத்தை பொறுத்தமட்டில் விசாரணை நடத்த சுப்ரீம் கோர்ட்டு சரியான அமைப்பு அல்ல என்பதுதான் காங்கிரஸ் கட்சியின் உறுதியான நிலைப்பாடு. மரியாதைக்குரிய சுப்ரீம் கோர்ட்டும் இதை ஒப்புக்கொண்டுள்ளது. பாரதீய ஜனதா கட்சி, தனது தவறான நடத்தைக்காகவும், சுப்ரீம் கோர்ட்டையும், நாடாளுமன்றத்தையும் தவறாக வழிநடத்தியதற்காகவும் மன்னிப்பு கேட்க வேண்டும். அவர்கள் எத்தனை பத்திரிகையாளர் சந்திப்பை வேண்டுமானாலும் நடத்தட்டும். ஆனால், உண்மையை அவர்கள் மறைக்க முடியாது.

Addressing a press conference after the Supreme Court dismissed the petitions seeking a probe into the deal, he said truth had triumphed and Gandhi’s “lies” had no legs to stand on.

Quoting from the judgment, Shah said the court expressed satisfaction with the process followed in purchasing the aircraft and set aside the demands of the petitioners for a probe into the matter.

He said the court agreed with the government’s contention that the country was financially benefited in the deal.

“The court observed that neighboring countries’ air forces were equipped with fourth and fifth generation aircraft. So there should not be any delay (in procuring the aircraft) in the interest of the country and it should not be stopped,” he said.

“The court also said that the government of India had no role in choosing the offset partner. It (judgment) is a slap on the face of Congress leaders,” Shah said.

Questioning Rahul Gandhi’s sustained attack on Prime Minister Narendra Modi and the government, he said Gandhi had harmed the country’s security interests and the morale of the forces by trying to stop the acquisition process.

Asking who had “directed” Gandhi to launch the campaign against the Rafale deal, he asked the Congress leader to reveal the source of information.

He also asked why Gandhi did not approach the Supreme Court if he had the evidence of corruption.

“Why did you run away from the court? You should have gone there. Your B-Team went there. Who stopped Rahul Gandhi from going to Supreme Court and place evidence of corruption?”

Shah also said the process for acquisition of fighter jets was initiated in 2001 and why did the UPA government not complete it during its tenure.

“Whether commission (kickbacks) stopped it,” he said, adding the Congress governments were experts in scams and it was laughable that they were raising doubts about Modi’s integrity.

The Modi government adopted a transparent process for the jet deal by going for a government-to-government deal.

Replying to questions on Rahul Gandhi’s description of Modi as ‘chowkidaar chor hai’ (watchman is a thief), he said only thieves were scared of a vigilant watchman.

“People have not doubted Prime Minister Modi or his government,” he said.

Referring to the Congress demand for a Joint Parliamentary Committee (JPC) probe into the deal, Shah said first let the issue be discussed in Parliament.

“Congress should come to Parliament and debate. Disruption is not a solution. The government is ready for any length of discussion. Even for constituting a JPC, there should be a discussion. How will you decide it? Will the Congress President set up a committee? We do not do match-fixing,” he asked.

Asked about the contract given to a private company to manufacture Rafale aircraft in preference over state-run HAL, Shah said: “No Rafale aircraft will be manufactured in India -neither by the private company nor by HAL. All 36 jets will be manufactured in France.”

Asked whether Gandhi’s campaign on Rafale during the elections had harmed the BJP, he said election defeats was a different issue. “We are not bothered about profit and loss. We are bothered about the harm it caused to the nation’s security.”

Talking to the media here, Congress leader in the Lok Sabha, Mallikarjun Kharge, said that the government wanted to speak on the judgment when the House was not in order.

“They are trying to hide the theft under the guise” of the PIL-triggered court judgment, he said.

The Congress was not allowed to seek clarifications after Home Minister Rajnath Singh made a statement in the Lok Sabha, he said.

“Our demand continues to be JPC (Joint Parliamentary Committee). They want to hide behind the judgment… We will not tolerate this, nor will the people of the country.”

Congress spokesperson Randeep Singh Surjewala also told reporters that there was corruption in the deal.

“There is multi-layered corruption in the deal. We know that the Supreme Court has no powers to look into all the aspects. So the Congress never went to the Supreme Court,” he said.

“I challenge (Prime Minister) Narendra Modi (to go) for a JPC probe. If you are not scared, why should there not be a JPC? The government will have to tell why the price of aircraft — the rate per aircraft has gone up from Rs 526 crore to Rs 1,670 crore,” he said.

Surjewala said “half-baked” information about the deal was given by the government to the Supreme Court.

The Supreme Court on Friday dismissed four petitions seeking court-monitored probe into the purchase of 36 Rafale jet fighters in ready-to-fly conditions holding that the decision-making process was not in doubt and it cannot go into the question of pricing and choice of offset Indian partner by the French aircraft manufacturer Dassault.

A bench comprising of Chief Justice Ranjan Gogoi and Justices S.K. Kaul and K.M. Joseph, reserved the order as Attorney General K.K. Venugopal defended the Narendra Modi government’s decision citing national security concerns.

Venugopal, however, admitted that there was no sovereign guarantee by the French government backing the deal obligating it to take the responsibility in case of default in delivery of the jets.

“All that is there is a letter of comfort from the French government,” he added.
