Supreme Court Clarifies Stand in Presidential Reference
During the two-month hearings on the Presidential Reference, the five-judge
Supreme Court Bench led by Chief Justice B.R. Gavai repeatedly said that it
was not reviewing or overruling the April 8 judgment in the Tamil Nadu Governor
case.
The President had used Article 143 of the Constitution to ask the Supreme Court
for advice on 14 questions. One key question was whether the Court can set
deadlines or rules for how Governors and the President should act under Articles
200 and 201 when dealing with State Bills sent for approval or reserved for
consideration.
