Parental Income Not Sole Creamy Layer Factor

The Supreme Court of India has given an important judgement stating that parental income alone cannot decide whether a candidate from the Other Backward Classes (OBC) belongs to the “creamy layer” category.

The judgement was delivered on March 11. The case was filed to remove confusion that has existed for many years about how the income and wealth test should be applied under the existing rules. This test is used to decide which OBC candidates are eligible for reservation benefits and which fall under the creamy layer category and are therefore not eligible.

The Court explained that simply looking at the income of the parents is not enough to determine creamy layer status. Other important factors must also be considered as per the regulations.

The issue was especially important for OBC candidates whose parents work in Central or State Public Sector Undertakings (PSUs) or in private companies. In many cases, it was unclear whether their jobs were equal to government posts, which created confusion in applying the rules correctly.

The judgement aims to bring clarity and consistency in the way the creamy layer criteria are implemented across the country. It is expected to help authorities apply the rules more fairly and avoid misunderstandings in future recruitment and admission processes.

Legal experts say the decision could have a significant impact on how reservation eligibility is assessed for OBC candidates, especially in cases involving employees of public sector and private organisations.
