Government Employees Are Part of ECI During Elections, Says Supreme Court

The Supreme Court has made an important clarification regarding the role of government employees during elections. It said that a claim made by the Trinamool Congress (Trinamool Congress) suggesting that West Bengal government staff are loyal to the party is incorrect.

On May 2, 2026, the court explained that all government employees—whether they work for the Central government or a State government—act under the authority of the Election Commission of India (Election Commission of India) when they are assigned election duties.

The judges clearly stated that these employees are neutral and do not support any political party. They are temporarily placed under the control of the Election Commission during elections to make sure voting is conducted in a fair and peaceful manner.

The court also called the idea that government workers are loyal to any political party a “fallacy,” meaning it is a wrong belief. It stressed that their job during elections is to follow rules and maintain fairness, not to favour any political group.

This clarification is important because free and fair elections depend on neutral officials. The court’s statement reinforces that government staff must remain unbiased while performing election duties, helping to protect the democratic process in the country.
